New York has the same laws, unless of course you have the "right" friends.

Good question... Theoretically the car should be running more efficiently with the chip, thereby having less emissions. But letter of the law vs. intent of the law means it would probably not be allowed so a switchable chip is probably a good idea. It would be neat for somebody with a switchable chip to test with & without the chip to see.

I haven't all the technical stuff at the tip of my tounge right now, but I promise you that, performance aside, adding the Reinhart chip will deliver cleaner burning and more fuel efficient performance results from improved AFRs, timing adjustments, engine temps and shift points. MPG will improve, but you find it difficult to prove that for a while, because you'll be out driving the s**t out of your new 4.6L DOHC street machine. The tree huggers will hug you, unless it's a rubber tree lover...
The SM at my dealer tested the chip at install and concurs, though I have no test results from that diagnostic at hand. SM says he recommended this mod to two other MM owners, and I've talked with them too. One will be test driving my MM this afternoon, but I don't know if they intend to upgrade.
Whether having this chip in place for an emission test is a liability or not, is your decision. I haven't been called for an emission test yet, and I don't know if I can just "volunteer" for testing. I'll look at this later, but until I know better, I see no reason to shut off, or, pull out for an emissions test. The law clearly states you cannot remove any emissions components without it being a necessary repair or replacement. However, the law does not prohibit you from adding more, which is why the SM reported my chip in the OASIS system.
I say "no worries, mate," but like a lot of other things kicked around here, glean your facts and draw your own conclusion.
