my car in the morning will not go in gear after sitting overnight-somebody to check the level of fluid on the dip stick to see if it higher -answer yes- i think the fluid is draining out of the t/c into the pan(no leaks)-when i let the car warm up after awhile it is fine-
what is the cause and can it get worse?

That's the first time I've ever heard that.
There is a stopper in the valve body that prevents the TC from draining.
It is possible that is letting fluid pass, or there is a loose, leaking valve body gasket.
If you are not afraid, I say drop tthe pan and replace the valve body gasket and inspect that stopper.
