View Full Version : really my first post, long time member, got screwed by salvage title please read.

Hello, I've been soaking up knowledge here for awhile now, never really posted tho. First off thanks for all the useful info., I've learned very much here. I've owned a Black 03 for 2 years now that I purchased from a dealership with a salvage title. Long story short, I wasn't origionally informed of the title on purchase which is illegal in MA. Car had 45k on it, instead of returning it I was offered a 4yr, 100k warranty covering absolutely everything. I took the deal, got the car for 15k and was fairly happy with it for 2 yrs. It now has 92k on it, and I recently spotted a silver 03 with 40k on it for 17k. I traded in my black one, the dealership paid of what I owed on it for the trade in, and I purchased an absolute cherry silver one. A month has now gone by and my bank called saying I was in risk of damaging my credit due to late payment of orig. loan. I called the dealership, found out he cancelled the check which payed off the black Marauder I traded in, due to the salvage title. I now own 2 Marauders that I cant' afford. Legally is there anything I can do. I'm thinkin I'm screwed. If so, whats a fair asking price for a mint 03' with 92k and a salvage title? Body and int. mint. many new parts. Appreciate the help, thanks.

I Think You Are Screwed.i Would Of Returned It To The Dealer.the Warranty Is No Good If You Think About It Now Cars Are Better Built.but Good Luck On The Sale.

They couldn't have possibly given you much on the trade. What's the payoff?
Is there enough equity in the new one to cover both?
Possible scenarios:
1
Ebay the black one with a reserve.
Post it here for sale
Get your note covered..
2
There may be enough value in the new one to cover both notes.
Refinance with a local bank. Get one payment. Have both cars.
3
Do #2. Sell the black car at your own pace.
Keep the cash or pay down the note.
Refinance again. Interest rate a payment will drop.

Call the BBB, call the local new paper, local news TV station etc. Call the sec. of state as well... if you signed your title to the car over to the dealer in agreement that he would pay x amount of money... then he turns around and tells you take back the car he doesn't want it... you have some phone calls to make.

Offer to just undo the deal w/o any out of pocket expense. Then no harm no foul.

I would be more mad than worried. Read your contract. Go after this crook.
He should be worried. In Minnesota he'd be in a world of hurt, pulling a stunt like that. But shoe on the other foot... if you bought it, without car fax, you would be stuck. grease for the goose, is grease for the gander.

Ususally when you trade/sell a car you have to present a clear marketable title. If there is a lien the dealer confirms the payoff with the bank.
If your state defines a "salvage" title as non-marketable or only marketable with disclosure failure of the seller to disclose same to buyer may render the trade in void.
If the dealer has not paid the lien holder then he can not sell the car and is out the amount of the trade.
As respects the dealer you got him, you have the Silver car for the price you want. The Dealer is stuck with the Black, assume you have a bill of sale and/or signed over title to Dealer on the trade.
All the bank can do is repo the car or try to get the money from the dealer for the payoff.
Point being you have the leverage, just undo the deal and you are right back to where you were.

I assume the dealer who is now rejecting the deal had to know the title was branded when they made the deal?

Was thinking the same^^. On second thought it sounds like a different dealer.
Was the dealer informed of the salvage title before the purchase/trade ?
A vehicle with a salvage title is very hard to sell and has diminished value.

The dealer was not aware of the salvage title until after the transaction took place. Legally I can do nothing. he does have a fine print clause on his sales agreement stating the car being traded in must have a clean non-salvage title. I now have the car back at my house and am the proud owner of 2 pretty marauders. I'm going to try to sell the black one to pay off the 10k I owe on it. Already have a few interested my younger bro. being one. It would be nice to keep em' both, I just have no need for 2 really, and I'm completely in love w/my new one. 10x's better than the black one. I know I'm gonna take a hit on it, but i was a sucker purchasing the salvaged one in the 1st place. Shoulda just took it back instead of taking the warranty. Althogh many new parts were replaced free of charge. Guess I didnt' do too bad. thanks for the responses.

yup.
Bought one of them also last Christmas. Its a long story with a bad ending. I'll type it out someday. It is really worth re-telling.
