Got a caouple of pocket knives I want to sell.

Have a benchmade appaarition that i carried for a few months. Still have box and all paperwork. It has the black oxide finish and partial serations. Never really cut anything but paper with it. Some wear on the pocket clip other wise pretty mint. Asking $65

Not really I wouldnt carry it unless you are looking for trouble though and criminal possesion of a weapon.

We've been charging PL265.01, Crim Poss Weap 4th, Class A Misd. for years. DA in our county considers them to be gravity knives. Multiple convictions. Different DAs may see it differently. Most people are unaware that switchblades are legal in NYS under particular circumstances. Do you know what they are?

You need a hunting and fishing license and if your military or le you can have them. NYS has found butterfly knifes not to be considered gravity knives. John jay college of criminal justice is were I go to school I aint a leo yet but I know a little about the law.

Penal Law article 265 outlaws various weapons, either possession with intent to use unlawfully, or mere possession. Various types of knives come within the CPW statutes, including a switchblade knife, gravity knife, dagger, dirk, razor, and stiletto. Penal Law § 265.01(1),(2). One type of knife that police have seized on numerous occasions is commonly known as a "butterfly knife." Decisions of New York State courts addressing possession of this instrument hold that it does not come within the definition of "gravity knife."

A switchblade can be carried a field in a tackle box while fishing in NYS with a current NYS license. That is the only exception to PL Section 265. Ask a ECPO. In my county in NYS, butterfly knives are considered gravity knives and we arrest for PL sect 265.01. As stated above. Have for many years. If there is a court decision that changed that I have not seen it. I can't imagine there is any other legitimate use for such a weapon other than to do bodily harm to someone.
With respect to other knives, all can be weapons, it all boils down to what was the person's intent for what he had it in his/her hand for. That applies to just about anything and I mean anything. I once onbtained a assault conviction where the weapon used was a 1/4# stick of butter.
