He needs to get that car.

Uniform Commercial Code.

UCC section 2328(d) provides that the last bona fide bidder in a no reserve auction has the right to enforce the bid and require the seller to make the sale. eBay conducts auctions, which are governed by the UCC.

If he paid his $500 deposit within 24hrs of closing the auction it is a legal contract.

This happened to a guy a few years ago who was the high bidder on a Honda S2000KR. Dealer lost his case in court and had to pay the bidders court costs too. Stealerships who put these cars up for no reserve and don't get the money the expected need to learn how to just suck it up and learn not to do it again.

Yes he did pay, the dealership was trying to refuse the deposit once they figured out what happened but it has already been sent and received via paypal.

A deal is a deal. They would nail you and I to a cross and burn it if we tried to back out of a deal that favored them!! I am currently going to trial in 2 weeks against a dealership who defrauded us. My lawyer told me Monday that the dealer has just been sued by another party recently. Its been over 3 years of waiting and now its my turn to hang and burn the dealer!!! :flamer:Revenge will be sweet!!

"Everybody loves their brand of car; Mustangs, Camaros, etc, but a gearhead is a gearhead. They love cars and will support one another if they can," explained Tony.
That statement has surely rung true as seen by the multiple posts on the forum wall.
"Chiming in from MercuryMaurader.net, Go Hitman!"
"Hey Hitman,
You got support from Columbusracing.com (5000+ members)
We are all following this story and hope you got a lawyer, that car is yours man."
"You have the support of Tacoma World Forums-- Good luck with getting the car!"

There is a "Like New" '09 Blue Challenger here with "LOW MILES" for $24,XXX.......If the guy bought it new for $60K he took a BLOOD BATH when he traded it!!

Are the used values on these cars that bad??

Well, no, if it's an SE, or even an R/T depending on the options. For an SRT, that would be extremely unusual. Typically, a low mileage SRT B5 Blue should retail in the mid 30's at least. And the list price for a B5 Blue SRT with all the options is $45K, not $60. Unless the dealer marked it up, which is idiotic, since the lots are full of Challengers now.

Is that the guy who won the bid met with the dealer today and they agreed to sell him the car for $35,000.00. He also gets, presumably, $2,000 in Mopar performance parts, which is a promotion by Dodge right now. That's an excellent price, and likely way below invoice and probably at the true cost to the dealer for the car with holdback and such. No official word yet, though.

The latest word is he got the car for 29.1K and posted a picture on the challenger site.

I am glad he got it. A deal is a deal, no matter what you think of either side.

Yeah, the other "latest" was a post from yesterday that turned out to be incorrect. Hitman had not yet reported in, and as of 9:06 AM this morning, he posted the dealer honored the Ebay bid and he got his car for $29.1K. A very astonishing deal.
