MartyO is a lawyer, but most states are right-to-work and they can terminate for no reason at all if they choose to. If it's with cause, she can't draw unemployment, but if they don't have a valid reason she'll get to draw it. And if it is turned down on initial application, appeal it.

You will need good documnetation to make a case - very difficult to do - such as a witness or emails, etc. Not an easy case to make regardless of the cirucmstances

I lost my job once for a BS reason. The job tryed to deny me drawing unemployment.The job and me each had to give a statement for why I was fired. I simply told the Unemployment Compensation office the reason I was told I had been fired.Because the reason they gave me did not make sense especially since I had 8 years in there I was awarded unemployment.

I'm sorry to hear about your wife. I think the only way for you to sue them is if you can prove negligence on their part or some form of illegality.

Sorry to hear of this. You might be able to get a free consultation from an attorney to see if her case has merit. My employer is currently involved in a case of wrongful termination under the Whistle Blower's Act. Should be interesting. :rolleyes: Good luck and no matter what, tell your wife better times are coming. ;)
