So after Finally getting my marauder and driving it for 2 weeks and having the engine go out, After 10 days of having my car the dealership called me yesterday and pretty much told me to get lost and they wont be helping or assisting in any repairs on the marauder and I am still required to pay the full amount of the loan. So it looks like it will be getting towed home and parked in my garage for a few months until I can save up enough to go all out on a new engine. Such a Giant let down , But hey, at least i know i have a clean Marauder parked and waiting for some love.

Why will they not cover it? How many miles did you put on it in those 10 days? Whatfailed on the motor? If it were me, I would not give up so easily. 10 days does not seem like a lot of time, unless you put several thousand miles on the car in that time. I think it would be in the best interest of the dealership to help support you in this ....

I had the Marauder for 19 days and either a piston rod or piston broke, I was never really told exactly what happened by 2 shops (All Free Because Friend/Family owned) but what it comes down to is the car was sold as is for $10,500 by a New/Used Mazda Dealership, after breaking down I went in and told them the situation and they said tow it to them and they will check it out, The guy that sold me the car said oh no problem, Service after the sale, we will take care of it, than the finance guy was like oh well we will cover %50 of the cost. Then 10 days later they call me and tell me well we will not be helping you with anything and it is your problem now. I also contacted lemon law lawyers and consumer affairs and was told im probably screwed

When the first person you talk to says,"Oh no problem." get it in writing. Dealerships are typically no out for you no matter what you buy or how much you spend...been on that side of the fence...

If it is a big New/Used Mazda dealership I would call the local news. We have 'Channel 7 on your side'. Sometimes just through the publicity of the event, they change their mind.
I would also get in writing what is wrong with the car. That will help determine the actual repair cost.
Questions I would ask:
1. If you had no intent to fix it, why did it take 10 days to inform of your decision?
2. If you had not intention of repairing it, why did you keep it for 10 days?
3. Your salesman stated 'no problem we will fix it' and your finance guy said 'we will cover 50%', why has the dealership mantra changed to 'no'?
4. What kind of inspection did you do on the vehicle prior to selling it? Please supply me those results.
Reality is that they found out the cost to repair it was going to cost them an arm and a leg, and they are now backing out. However, that looks really poor on them. They do not have a duty to fix it, but if a brand name dealership sold me a used car 'as-is', I would expect it to last longer than 19 days.
What is the name of the dealership?

Most states have a "30 day lemon law" but theres always two sides to every story.

Man I feel for you! Selling and buying used cars is such a risk. What if they knowingly sold you a car with a bad engine? What if you beat the snot out of it trying to scam them for a new trans and oops, the engine went instead? They may just be hoping you feel guilty or scared to press an issue that you created? Maybe they just hope you get scared off or feel like you truly have no rights? Maybe you just don't and they know it?
No matter, it truly sucks to see someone finally get their dream car, or any car for that matter, and have a failure like this.
Sounds as if they are stalling to hit a deadline of rights they know you do have...

Read the paperwork you signed. In my business as a Realtor I have learned that water heaters, A/C units, and fridges seem to fail with in a week of whenever a new buyer moves in. Even with independent inspections. Its like equipment seems to sense change of ownership. Lemon laws only apply if the paperwork you signed has different terms. If you signed it, you agree'd to it. You can become a squeaky wheel and see if you get oiled but most of the time in the car world they could give 2 ***** less.

I dunno about California, but NY has 90day under 36K miles, 60Day under 60K miles and 30day warranty up until 100K miles. Look into that.

Be a squeaky wheel, raise hell. Call them on what they said at first on paying %50, call that guy out then go to his boss or owner and drop that guys name 50 times or more. As is is what it is, as is. Lemon law won't help I'm afraid. But big brand dealers do typically help in situations like this even if it turns out to be a loss...but not until the owner has stormed the showroom with torches and pitchforks declaring BS on what they sold. I doubt the dealer knew the car was junk but being its used and not a Mazda they could care less. Don't give up, I've seen these situations before in the last 20 years I've worked at my dealer and it almost always works in the customers favor.
And sorry but congrats on the Marauder:)

Man that's a load of crap! The dealership I work for always takes care of customers, I've never seen them turn one away even in instances like this! It takes a real special circumstance for them to tell one of our customers to F.O. I hope that you can get their mind changed! Call them repeatedly and raise hell! If you keep making your voice heard, something will get done. Sounds like they are playing the usual game, tell you that you're screwed, and hope that you just go away. If they are a dealership of decent size and reputation, and you become their worst nightmare, I'd bet they change their mind.

I know it's as is, but 2 weeks :confused: yea defiantly call the news and you will be a bigger squeaky wheel. And of course you are now the poor broke kid that spent your money and now have a big loan to pay off with no ride.:argue: They might work out something? Just saying, don't just give up.

Dude I think you just got ****ed!
There is a no lemon law which is only covered within the first 30 days. They CLEARLY kept the car for 10 days because this would expire the 30-day no lemon warranty...then they come out and say F U there's nothing you can do about it anymore.
This happened to my friend with a subaru WRX STI, they kept the car for almost two weeks before saying we can't help you. He had to sell his motorcycle to pay for a new engine.
I would go in there and cuss up a storm then head to the local news channel.
EDIT: Also, my buddy too purchased his car used from a Mazda dealership!

Tomorrow is actually exactly 30 days so i guess i will go in there and raise more hell and call the finance guy out on his claim they would pay %50, all in all though this does suck and I got F'd in the A
Also forgot to mention that today i was told they would have it towed to me within the hour, so i called 3 hours later and told the guy i had no car still and he started yelling at me about how it takes longer than 10 minutes to tow and how hes trying to help me out and pay for it and i told him he doesnt have to get loud with me and than he hung up on me... Lame right? I also recorded this conversation on my computer

Social media is where it's at today. I'm at a Ford dealer and when we get a bad review we are all over it, have seen the owner himself post replies.
Twitter Facebook Yelp Yahoo...there are more but these are the main ones that come to mind. Search the dealers name and find their homepage on these site and then...34060

I agree....
They will stall or bluff you until you put enough pressure on them where they have to do something......
The last thing you want to do is go away quietly, that's exactly what they want....
Hell, I'd show up on a busy weekend when the place is packed and start raising hell in front of other possible buyers that you were sold a used car with a bad engine and this place won't stand behind what they sell...

Post that audio conversation on FB for all to hear the quality of their customer service. I would even go back with a hidden camera which the local news station would love, as I'm sure they will treat you reaaaaaaal nice when you show up.

I dont really do any of the facebook/twitter type of stuff but i probably will go in with a camera and im sure they will be rude and unhelpful again, but thanks everyone for all of your comments and reply's. I will continue giving them **** at least until i get some answers because all they really told me was i need a new engine then they ignore me for days then tell me to get lost

Well here in NY, over 100K its sold as is, it could blow motor down the block from the lot when you drive off and you're stuck.

This was my point above.
I tried to do some quick CA research for him but did not find anything terribly promising for him. Keep in mind I do not practice in CA though.

Does the California Lemon Law apply to used vehicles?
Yes, if the repair visits occurred within the original or extended warranty period.
California seems to have a 48hr return period in a clause somewhere.
If the car was sold "as-is" I think you are screwed once you drive off the lot. You may want to stick to the manager saying they'll cover 50% and another guy saying something else as ammunition.
